1. Scope and provider
These Terms of Service ("Terms") govern use of Inqvesta (https://inqvesta.de), operated by Tim Schuldt, Schulstraße 24, 63179 Obertshausen, Germany ("Provider", "we").
Inqvesta is intended primarily for professional and business users (B2B). By creating an account you confirm you act in a professional or business capacity unless otherwise agreed in writing.
2. Contract formation
A contract is formed when you complete registration, accept these Terms and our Privacy Policy, and we confirm account creation (or send a verification email for email/password signup).
We may refuse registration without stating reasons, particularly in cases of abuse or legal concerns.
3. Account and security
You must provide accurate information and keep credentials confidential. You are responsible for activity under your account.
Organisation administrators may invite team members and assign roles. You must ensure invitees are authorised to access your organisation's data.
You must not share accounts, circumvent access controls, or use the service for unlawful purposes.
4. Service description
Inqvesta provides tools for financial modeling, equity research, document analysis, and AI-assisted research workflows.
Features, credit allowances, and availability may change. We strive for high availability but do not guarantee uninterrupted access.
Market data and third-party content may be subject to separate licence terms. You are responsible for compliance with applicable data licences.
5. AI-generated content
AI outputs are generated automatically and may contain errors, omissions, or outdated information. They do not constitute investment advice, a recommendation, or an offer.
You must independently verify AI-generated content before relying on it for investment or business decisions.
Do not submit personal data of third parties or confidential information without legal authority.
6. Fees and credits
Certain features consume AI credits according to the published credit policy. Monthly allowances depend on your user type.
Paid plans or top-ups, if offered, are billed according to the respective order confirmation. Prices include applicable VAT where stated.
Unused credits may expire according to the credit policy in effect at the time of grant.
7. Availability and maintenance
We may perform maintenance, updates, or security patches that temporarily limit availability.
We are not liable for outages caused by force majeure, third-party infrastructure failures, or circumstances outside our reasonable control.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and under the Product Liability Act.
For slight negligence we are liable only for breach of essential contractual obligations (cardinal duties), limited to foreseeable, typical damage.
Liability for lost profits, indirect damage, and data loss beyond reasonable backup scope is excluded to the extent permitted by law.
Financial data and research outputs are provided for informational purposes only. We assume no liability for investment decisions based on platform content.
9. Term and termination
The contract runs for an indefinite period unless a fixed term is agreed separately.
You may delete your account or cease use at any time. We may suspend or terminate accounts for material breach, abuse, or legal requirements with reasonable notice where feasible.
Upon termination, access ends and data is deleted or retained as described in the Privacy Policy.
10. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction is the Provider's registered address. Mandatory consumer protection provisions remain unaffected where applicable.
11. Changes to the Terms
We may amend these Terms for legal, technical, or commercial reasons. Material changes will be notified in advance; continued use after the effective date constitutes acceptance unless you object or terminate.
